1. Introduction

Welcome to Pawsibu, a digital platform owned and operated by Pawsibu Ltd ("Pawsibu", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Pawsibu mobile application, website, and all related services (collectively, the "Platform"). By accessing, creating an account, or using any part of Pawsibu, you ("you", "user", "pet owner", "service provider", or "vendor") agree to be bound by these Terms. If you do not agree, please discontinue use of the Platform immediately.

2. Scope of the Platform

Pawsibu provides a digital marketplace and service platform that connects: Pet Owners/Clients – users seeking pet services, products, or bookings. Service Providers – individuals or businesses offering grooming, veterinary care, boarding, daycare, training, transport, mating/stud, or other pet-related services. Vendors/Sellers – users listing and selling pet products or supplies through Pawsibu's e-commerce system. Riders/Drivers – users providing pet transport or delivery services. Pawsibu acts solely as an intermediary between users and is not a direct provider of any service or product listed on the Platform.

3. Eligibility

You must: Be at least 18 years of age, or the age of legal majority in your jurisdiction; Have the legal capacity to enter into binding agreements; and Use the Platform in compliance with all applicable laws and regulations.

4. Account Registration

To access most features, users must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Pawsibu reserves the right to suspend or terminate any account that violates these Terms or engages in fraudulent, abusive, or unlawful conduct.

5. Escrow and Payments

5.1 Payment Processing All payments on Pawsibu are processed securely through Flutterwave or other approved payment gateways. By using the Platform, you agree to comply with Flutterwave's terms and applicable financial regulations. 5.2 Escrow System When a Pet Owner books a service or purchases a product: The payment is held in escrow by Pawsibu until the service is confirmed as completed or the product is delivered. Upon confirmation, Pawsibu releases the payment to the Service Provider or Vendor, less applicable fees. 5.3 Commission and Fees Service Providers and Vendors: 15% commission is deducted from earnings per transaction. Clients/Pet Owners: 10% service fee is charged on each booking or purchase. All prices shown on the Platform are inclusive of these charges unless otherwise stated. 5.4 Cancellations and Refunds Refunds are handled according to Pawsibu's Refund Policy, accessible on the Platform. Refund eligibility depends on service status, provider agreement, and verification by Pawsibu Support.

6. Loyalty and Reward System

Pawsibu may offer a Loyalty Program allowing users to earn and redeem reward points ("PawsPoints") through transactions, reviews, or referrals. Points: Have no monetary value outside the Platform. Cannot be sold, exchanged, or transferred. May expire or be revoked in cases of misuse or inactivity.

7. Push Notifications and Communications

By using the Platform, you consent to receive: In-app and push notifications for bookings, messages, service updates, and promotional offers. Transactional and support-related emails or messages. You can opt out of non-essential notifications in your account settings.

8. User Responsibilities

You agree to: Use the Platform lawfully and respectfully. Provide accurate information about pets, services, or products listed. Ensure your listings comply with applicable veterinary, animal welfare, and consumer protection laws. Not misuse or attempt to manipulate Pawsibu's escrow, review, or rating systems. Service Providers and Vendors must: Deliver services and products as described. Maintain professional standards, safety, and hygiene. Avoid misleading claims, fake listings, or abusive behavior toward clients.

9. Pawsibu's Role and Limitations

Pawsibu is a marketplace intermediary. We: Do not own, sell, or operate any pet-related business directly on the Platform. Are not liable for the quality, safety, legality, or outcome of services or goods provided by users. Facilitate payments and dispute resolution but do not guarantee outcomes. Users engage with each other at their own risk and discretion.

10. Content Ownership and Intellectual Property

All content, software, logos, and materials available on Pawsibu are the exclusive property of Pawsibu Ltd and protected under international copyright and trademark laws. Users may post content (e.g., listings, reviews, images), but by doing so, they grant Pawsibu a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content in connection with the Platform. Pawsibu reserves the right to remove or moderate content that violates laws or community standards.

11. Dispute Resolution

11.1 Internal Resolution All disputes should first be reported to Pawsibu Support via the in-app help system or email. We will attempt to mediate and resolve the issue within 7–14 business days. 11.2 Jurisdiction and Governing Law Transactions and disputes are governed by the laws of the country where the transaction took place. For international disputes, Pawsibu will determine governing law based on where the fault or breach originated. Complex disputes may be referred to arbitration or the competent court in the user's country of residence or as determined by Pawsibu. 11.3 Limitation of Liability To the maximum extent permitted by law, Pawsibu, its affiliates, employees, and partners shall not be liable for: Any indirect, incidental, or consequential damages; Service failure, delay, or cancellation caused by third parties; Losses due to unauthorized account access, network interruptions, or payment issues beyond our control.

12. Termination and Suspension

Pawsibu may, at its discretion, suspend or terminate accounts that: Violate these Terms; Engage in fraudulent or harmful activities; Misuse escrow or loyalty systems. Upon termination, all pending transactions will be reviewed and settled per the escrow policy.

13. Privacy and Data Protection

Your privacy is important to us. Pawsibu processes personal data in accordance with its Privacy Policy, which complies with: The Nigeria Data Protection Act (NDPA); and The EU General Data Protection Regulation (GDPR) for global users. We use encrypted protocols and secure storage to protect user information.

14. Modifications to Terms

Pawsibu reserves the right to update or modify these Terms at any time. Users will be notified via email, push notification, or in-app alert before significant changes take effect. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

15. Indemnification

You agree to indemnify and hold harmless Pawsibu, its officers, directors, employees, and affiliates from any claims, liabilities, damages, or expenses arising from: Your use of the Platform; Your breach of these Terms; or Your violation of any law or third-party rights.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, along with the Privacy Policy and any additional guidelines or service-specific terms, constitute the entire agreement between you and Pawsibu regarding the Platform and supersede all prior agreements.
